On the accession of the USSR to the Agreement on Privileges and Immunities of the International Atomic Energy Agency (IAEA)

The USSR Council of Ministers resolves that:

1. The Union of SSR will accede to the Agreement on Privileges and Immunities of the International Atomic Energy Agency, confirmed by the IAEA Board of Governors on 1 July 1959.

2. To direct the USSR Ministry of Foreign Affairs to:

a. Formulate the accession of the USSR to the Agreement specified in Point 1;

b. To make the following reservation on the disavowal by the Soviet Government of the obligatory jurisdiction of the International Court:

“The Union of Soviet Socialist Republics does not consider itself bound by the provisions of Sections 26 and 34 of the Agreement envisioning the obligatory jurisdiction of the International Court. In regard to the jurisdiction of the International Court on disputes on interpretation and application of the Agreement, the USSR will adhere, as it has done up to this time, to the position that for each separate instance the consent of all sides party to the dispute is required for the transfer of that or some other disagreement for resolution of the International Court. This reservation relates in equal degree as well to the stipulation contained in section 34 envisioning that a consultative conclusion of the International Court shall be accepted as decisive.”
